第 1 条 条款适用范围
1.1 本条款(以下简称“本规范”)系由 DEHOING IDTX 及其关联机构(统称“IDTX”)制定,适用于阁下通过 IDTX 提供的下列产品与服务所进行的第三方内容创作、上传、发布及传播活动:

1.2 本规范同时适用于 IDTX 日后上线的、与上述产品或服务存在继承性、延伸性或替代性关系的平台及应用,除非 IDTX 另行以书面形式明示排除适用。
1.3 凡通过上述产品及服务提交、上传、存储、分享、发布或传播内容的自然人、法人或其他组织(以下简称“阁下”),均视为已阅读、理解并同意受本规范之约束。若阁下不同意本规范之全部或部分内容,应立即停止使用相关产品与服务。
1.4 本规范为阁下与 IDTX 就第三方内容创作与上传所确立之具有法律效力的约定,构成本规范所涉产品和服务使用的必要条件,并与《IDTX 平台用户服务协议》《IDTX 隐私政策》《CNRS 推广原则》等相关规则一并适用。
第 2 条 定义说明
2.1 第三方内容
“第三方内容”系指阁下通过 IDTX 平台及其关联服务提交、上传、存储、分享、发布或传播的全部信息、数据、作品及相关材料。该等内容包括但不限于:
- 文字、图像、音频、视频及其衍生形式;
- 软件、脚本、源代码、可执行文件及相关技术成果;
- 数据库、数据集及其索引结构;
- 设计、艺术作品、文学作品、学术论文与研究成果;
- 转载、改编、翻译、汇编或其他经合法授权的非原创性内容;
- 其他经由用户合法取得之信息。
2.2 第三方创作
“第三方创作”系指阁下基于其独立构思、劳动投入或合法改编,完成并提交的作品或成果。该等创作既可以是原创内容,亦可以是依法转载或经授权改编的非原创内容。
2.3 原创性
“原创性”系指由阁下独立完成的第三方内容,不包含对他人已有作品的未经授权的复制或使用。
2.4 认证证书
“认证证书”系指由国家机关、国际组织、行业协会或独立权威机构依法颁发,用以证明阁下提交内容具备原创属性之法律性或事实性文件。
第 3 条 内容创作原则
3.1 阁下应当积极上传原创内容,以促进 IDTX 平台的公平竞争与可持续发展。
3.2 当阁下上传内容并标记为原创时,阁下须向 IDTX 提交原创性认证证书,以供审核和存档。
3.3 原创性认证证书的权威性排序如下(由高至低):
(一)联合国安理会五个常任理事国(中国、美国、俄罗斯、英国、法国)的国家机关依照其国家标准与法律规定所颁发的知识产权证书:
- 中国:《中华人民共和国著作权法》下发之计算机软件著作权登记证书、专利证书等;
- 美国:United States Copyright Registration Certificate(美国版权局颁发)、U.S. Patent and Trademark Office (USPTO) Patent Certificate;
- 俄罗斯:Rospatent Certificate of State Registration(俄罗斯联邦知识产权局颁发之专利与版权登记证书);
- 英国:UK Intellectual Property Office (UKIPO) Copyright or Patent Certificate;
- 法国:Institut National de la Propriété Industrielle (INPI) Certificat de Brevet ou de Droit d’Auteur(法国工业产权局专利/著作权证书)。
(二)其他受国际认可的原创性认证证书
- 例:World Intellectual Property Organization (WIPO) Copyright Registration、Creative Commons Certificate of Originality。
(三)联合国及相关机构所颁发的证书
- 例:UNESCO Copyright Certification、United Nations Industrial Development Organization (UNIDO) Intellectual Property Recognition。
(四)CNRS Authority 认证证书。
(五)其他经 IDTX 认可的第三方独立机构出具的原创性认证文件。
3.4 当两名或以上创作者就同一作品提交原创性申请且存在权属冲突时,IDTX 将依据认证证书的权威性排序进行审查与裁定:
- 持有五常国家机关颁发之知识产权或著作权证书者,优先获得原创性认定;
- 若所提交证书权威性等同,则 IDTX 有权根据提交时间、证书有效性、作品独创性程度及其他合理因素作出最终裁定。
3.5 阁下须保证所提交认证证书真实、合法、有效,不得伪造、篡改或冒用。一经发现违规行为,IDTX 有权撤销阁下的原创认证资格,并保留依法追究相关法律责任的权利。
3.6 在获得原创认证后,除另有法律规定或另行约定外,相关著作权及相关权益归阁下所有。IDTX 在符合法律及本规范约定的范围内,享有基于该内容的展示、传播与合理使用权。
第 4 条 内容上传限制
4.1 若阁下在使用 IDTX 平台特定产品(包括但不限于 CNRS Books、CNRS TV+、天下社区)上传内容时,平台要求填写年龄导向或内容分级信息,阁下须保证所填信息完整、真实、准确。若因阁下提供虚假或错误信息而导致不适龄人群接触该内容,由阁下自行承担一切后果。
4.2 阁下在 IDTX 平台上传、发布或传播内容时,不得违反《中华人民共和国宪法》《中华人民共和国网络安全法》《中华人民共和国数据安全法》《中华人民共和国个人信息保护法》《中华人民共和国著作权法》及其他现行有效的法律法规。尤其禁止上传、制作、复制、传播以下内容:
(一)危害中华人民共和国国家安全、主权和领土完整之内容;
(二)煽动颠覆国家政权、推翻社会主义制度或分裂国家、破坏国家统一之内容;
(三)煽动民族仇恨、民族歧视、宣扬民族独立或分裂主义之内容;
(四)传播恐怖主义、极端主义或教唆实施违法犯罪行为之内容;
(五)淫秽、色情、赌博、暴力、凶杀、恐怖或教唆犯罪之内容;
(六)违反公序良俗或侵害社会公共利益之内容;
(七)侵犯任何第三方知识产权或其他合法权益之内容。
4.3 若阁下上传转载内容,且平台上已存在相同或高度相似之转载内容,IDTX 有权依其独立判断拒绝后者的上传,以保证平台内容的清洁性、独特性与优质性。
4.4 除前述限制外,IDTX 遵循自由与个性原则,充分尊重阁下的合法表达权。阁下可在遵守法律与本规范的前提下,自由上传与分享内容。
第 5 条 举报与反馈
5.1 任何用户均有权对涉嫌违规之内容进行举报。举报应提供必要的证据材料,以便平台审查。
5.2 IDTX 在接获举报后,将依照法律法规及本规范进行核查与处理。对确属违规之内容,IDTX 有权立即删除或屏蔽,并视情节轻重对责任用户采取包括但不限于警告、限制功能、冻结账号或永久终止服务之措施。
5.3 如阁下对平台服务、审核结果或相关政策有任何意见或建议,阁下可通过 IDTX 提供的官方渠道提交反馈。IDTX 将在合理期限内予以回复或说明。
第 6 条 追责与协议终止
6.1 阁下因上传或传播内容而引发的任何法律纠纷、侵权责任或损害赔偿,由阁下自行承担全部责任。
6.2 若阁下严重违反本规范或中华人民共和国现行法律法规,IDTX 有权在不事先通知的情况下,立即终止与阁下的服务协议,并永久冻结阁下的账号。
6.3 协议终止后,IDTX 仍保留就阁下在服务期间的违规行为追究法律责任之权利。
第 7 条 多语言版本声明
7.1 本规范以中文版本为唯一具有法律效力之版本。
7.2 任何其他语言之译本仅供参考。如译文与中文版本存在任何歧义、遗漏或冲突,概以中文版本为准。
第 8 条 附则
8.1 本规范自 2025 年 9 月 1 日 起施行。
8.2 本规范未尽事宜,适用中华人民共和国现行法律法规。
8.3 本规范之最终解释权归 IDTX 所有。
8.4 如本规范部分条款因法律规定被确认无效,不影响其余条款之效力。
8.5 本规范条款为基础原则,对于条款中尚未明确规定的事项,IDTX 相关平台负责审核内容、处理举报、裁定原创性事宜;IDTX 对外事务管理办公室及相关专案人员有权依据合理理由进行判例裁决或制定新的规范,以保障平台秩序及权利义务之平衡。

Article 1 – Scope of Application
1.1 This Terms of Service (hereinafter referred to as “these Guidelines”) are established by DEHOING IDTX and its affiliates (collectively, “IDTX”) and shall apply to any third-party content creation, uploading, publication, or distribution activities conducted by You (hereinafter “You”) through the following products and services provided by IDTX:
- IDTX News
- Today At Aura
- Démon Drive (Démon Shared Cloud Storage)
- Tianxia Community
- Tianxia News
- Démon Community
- Tianxia Creators Center
- CNRS Store
- CNRS App Store
- CNRS Books
- CNRS News
- CNRS TV+ (IDTX MOVIE)
- CNRS Web Directory
1.2 These Guidelines also apply to any future platforms or applications launched by IDTX that bear inheritance, extension, or substitution relationships with the aforementioned products or services, unless explicitly excluded in writing by IDTX.
1.3 Any natural person, legal entity, or other organization submitting, uploading, storing, sharing, publishing, or distributing content through the aforementioned products and services shall be deemed to have read, understood, and agreed to be bound by these Guidelines. If You do not agree with all or part of these Guidelines, You must immediately cease using the relevant products and services.
1.4 These Guidelines constitute a legally binding agreement between You and IDTX regarding third-party content creation and uploading. They form a necessary condition for using the relevant products and services and are applicable together with the IDTX Platform User Service Agreement, IDTX Privacy Policy, CNRS Promotion Principles, and other related rules.
Article 2 – Definitions
2.1 Third-Party Content
“Third-Party Content” refers to all information, data, works, and related materials submitted, uploaded, stored, shared, published, or distributed by You through the IDTX platform and its affiliated services. Such content includes, but is not limited to:
- Text, images, audio, video, and derivative forms thereof;
- Software, scripts, source code, executable files, and related technical results;
- Databases, datasets, and indexing structures;
- Designs, artworks, literary works, academic papers, and research results;
- Reproduced, adapted, translated, compiled, or otherwise lawfully authorized non-original content;
- Other legally obtained information by the user.
2.2 Third-Party Creation
“Third-Party Creation” refers to works or results completed and submitted by You based on independent conception, labor input, or lawful adaptation. Such creations may be original content or lawfully reproduced/adapted non-original content.
2.3 Originality
“Originality” refers to third-party content independently completed by You and does not include unauthorized copying or use of others’ pre-existing works.
2.4 Certification
“Certification” refers to a legal or factual document issued by a national authority, international organization, industry association, or independent authoritative institution to certify that the submitted content possesses attributes of originality.
Article 3 – Content Creation Principles
3.1 You are encouraged to actively upload original content to promote fair competition and sustainable development of the IDTX platform.
3.2 When You upload content and designate it as original, You must submit an originality certification to IDTX for review and record.
3.3 The authority ranking of originality certifications is as follows (from highest to lowest):
(a) Intellectual property or copyright certificates issued by national authorities of the five permanent members of the UN Security Council (China, USA, Russia, UK, France) according to their national standards and laws:
- China: Registration certificates for computer software copyright, patent certificates under the Copyright Law of the People’s Republic of China;
- United States: United States Copyright Registration Certificate, U.S. Patent and Trademark Office (USPTO) Patent Certificate;
- Russia: Rospatent Certificate of State Registration (patent and copyright registration certificate issued by the Russian Federal Service for Intellectual Property);
- United Kingdom: UK Intellectual Property Office (UKIPO) Copyright or Patent Certificate;
- France: Institut National de la Propriété Industrielle (INPI) Certificat de Brevet ou de Droit d’Auteur.
(b) Other internationally recognized originality certifications, e.g., World Intellectual Property Organization (WIPO) Copyright Registration, Creative Commons Certificate of Originality.
(c) Certifications issued by the United Nations and related institutions, e.g., UNESCO Copyright Certification, United Nations Industrial Development Organization (UNIDO) Intellectual Property Recognition.
(d) CNRS Authority certification.
(e) Other originality certifications issued by independent third-party institutions recognized by IDTX.
3.4 In cases where two or more creators submit originality claims for the same work with conflicting rights, IDTX shall review and adjudicate based on the ranking of the submitted certifications:
- Holders of IP or copyright certificates issued by the five permanent member states shall have priority in obtaining originality recognition;
- If the submitted certificates have equivalent authority, IDTX reserves the right to make the final decision based on submission time, certificate validity, degree of work originality, and other reasonable factors.
3.5 You must ensure that any submitted certification is authentic, lawful, and valid, and shall not be forged, altered, or misappropriated. Any violation may result in revocation of originality recognition and potential legal liability.
3.6 Once originality is certified, unless otherwise provided by law or separate agreement, related copyright and associated rights shall belong to You. IDTX shall enjoy the rights to display, distribute, and reasonably use the content within the scope permitted by law and these Guidelines.
Article 4 – Content Upload Restrictions
4.1 When uploading content to certain IDTX products (including but not limited to CNRS Books, CNRS TV+, Tianxia Community), if the platform requires age guidance or content rating, You must provide complete, truthful, and accurate information. Any consequences arising from false or incorrect information shall be borne solely by You.
4.2 You shall not upload, publish, or distribute content on the IDTX platform in violation of the Constitution of the People’s Republic of China, Cybersecurity Law, Data Security Law, Personal Information Protection Law, Copyright Law, or other applicable laws and regulations. In particular, the following content is strictly prohibited:
- Content endangering national security, sovereignty, or territorial integrity of the PRC;
- Content inciting subversion of state power, overthrow of the socialist system, or separatism;
- Content promoting ethnic hatred, discrimination, independence, or separatism;
- Content spreading terrorism, extremism, or inciting illegal activity;
- Obscene, pornographic, gambling, violent, murderous, terrorist, or criminally inciting content;
- Content violating public order and morality or harming public interest;
- Content infringing any third-party intellectual property or other legal rights.
4.3 If You upload reproduced content that is identical or highly similar to content already on the platform, IDTX reserves the right to reject the subsequent submission at its sole discretion to maintain content quality and uniqueness.
4.4 Beyond the above restrictions, IDTX respects personal freedom and individuality. You may freely upload and share content within the bounds of law and these Guidelines.
Article 5 – Reporting and Feedback
5.1 Any user may report content suspected of violating these Guidelines. Reports must provide sufficient evidence for platform review.
5.2 Upon receiving a report, IDTX shall investigate and take action in accordance with laws and these Guidelines. Verified violations may result in immediate deletion or blocking of content, and sanctions including but not limited to warnings, function restrictions, account suspension, or permanent termination.
5.3 If You have any opinions or suggestions regarding platform services, review results, or related policies, You may submit feedback through IDTX official channels. IDTX will respond within a reasonable timeframe.
Article 6 – Liability and Termination
6.1 You shall bear full responsibility for any legal disputes, infringement claims, or damages arising from the content You upload or distribute.
6.2 If You seriously violate these Guidelines or applicable PRC laws, IDTX may, without prior notice, terminate your service agreement and permanently suspend your account.
6.3 Termination does not affect IDTX’s right to pursue legal liability for any violations occurring during the service period.
Article 7 – Multilingual Versions
7.1 The Chinese version of these Guidelines is the sole legally binding version.
7.2 Any translation into other languages is for reference only. In case of any discrepancy or ambiguity between translations, the Chinese version shall prevail.
Article 8 – Miscellaneous
8.1 These Guidelines shall take effect on September 1, 2025.
8.2 Matters not covered herein shall be governed by applicable laws of the People’s Republic of China.
8.3 The final interpretation of these Guidelines shall be vested in IDTX.
8.4 If any provision is deemed invalid by law, it shall not affect the validity of the remaining provisions.
8.5 These Guidelines serve as foundational principles. For matters not explicitly addressed, relevant IDTX platforms are responsible for content review, handling reports, and adjudicating originality disputes; the IDTX Office of External Affairs and related project personnel are authorized to make case-based decisions or establish new rules to ensure platform order and balance of rights and obligations.
